1. Acceptance of these terms
These Terms of Service ("Terms") govern your use of https://jobs.waypointrecruit.com and the related dashboard, APIs, and services (collectively, the "Service") operated by Waypoint Recruitment and Staffing, Inc. ("Waypoint", "we", "us"). By creating an account, posting a job, clicking an apply button, or otherwise using the Service, you agree to be bound by these Terms and our Privacy Policy.
If you are using the Service on behalf of an organization (a "Hospital" or "Client"), you represent that you are authorized to bind that organization to these Terms, and "you" refers to both you and that organization.
2. What the service does
Waypoint operates a healthcare-only job board. We aggregate publicly listed hospital and travel-nursing positions from third-party career sites, and we host job listings posted directly by Clients ("Open Roles"). Job seekers browse listings and are routed to the hiring organization's own applicant-tracking system to apply.
We do not screen candidates, conduct interviews, make employment decisions, or act as an employment agency. Apply clicks route directly to the Client's URL and Waypoint does not collect, store, or transmit candidate application materials.
3. Accounts and account approval
Clients may create an account through the /signup form. New accounts begin in "prospect" status and are reviewed by Waypoint before activation. We reserve the right to refuse or revoke any account at our discretion, including for misrepresentation of authority, incomplete information, or use that conflicts with these Terms.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account. Notify us immediately at info@waypointrecruit.com if you suspect unauthorized access.
4. Billing and payment
Free job listings carry no charge. Sponsored listings are billed on a per-apply-click basis at the rate associated with the chosen tier (Starter, Featured, or Premium). The applicable rate is shown on the role's settings page in your dashboard and is stamped on each billable click at the time of the click.
Sponsored billing is postpaid on a weekly cycle. Each Friday at approximately 6 PM UTC, we sum the prior week's billable clicks and charge the credit or debit card on file via Stripe. Receipts are emailed to the billing address on your account. A current and valid payment method is required to keep sponsored roles active.
- If a weekly charge fails, we will retry the following Friday and notify the billing contact.
- Three consecutive failed weekly charges will automatically pause sponsored placement on all of your roles. Free placement is not affected.
- Hospital systems requiring net-30 invoice billing may contact info@waypointrecruit.com to arrange enterprise terms. Once enterprise terms are in place the weekly auto-charge cycle does not apply.
5. Your obligations as a hospital or recruiter
You are solely responsible for the accuracy, lawfulness, and currency of the roles you post. You agree that each Open Role:
- Is a real, currently open position at the organization you represent or are authorized to recruit for;
- Complies with all applicable employment laws, including EEO, ADA, and state-specific wage-disclosure rules;
- Has a working apply URL that routes to the organization's own applicant-tracking system (no third-party redirects, no aggregator wrappers);
- Will be marked closed or removed when filled.
You agree not to post the same role through multiple accounts to inflate visibility, not to use Waypoint to solicit work outside the role's apply flow, and not to post roles for which you do not have authorization to recruit.
6. Acceptable use
You agree not to: (a) attempt to access another account or our infrastructure without authorization; (b) scrape, mirror, or systematically download our content beyond normal browsing; (c) interfere with the Service or its security; (d) reverse-engineer or attempt to extract source code; (e) use the Service to send unsolicited communications to candidates or competitors; (f) misrepresent your identity or organization.
Waypoint reserves the right to remove content, suspend access, or terminate accounts that violate these provisions.
7. Intellectual property
You retain all rights to content you submit (job descriptions, organization names, logos). You grant Waypoint a worldwide, non-exclusive, royalty-free license to display, distribute, and surface that content through the Service for as long as your account is active or the content remains posted.
Waypoint retains all rights to the Service itself — the software, the design, the aggregated data we collect, and the brand. Nothing in these Terms transfers ownership of either party's intellectual property.
8. Aggregated and de-identified data
We may use aggregated, anonymized data derived from Service usage (such as click-through rates, regional candidate interest, time-on-page, applied-to-impression ratios) to improve the Service, publish industry benchmarks, and inform product decisions. Aggregated data does not identify any individual or specific Client.
9. Termination
You may close your account at any time by emailing info@waypointrecruit.com. Termination does not waive amounts owed for clicks already incurred; the final partial-week charge will run on the next normal billing Friday.
Waypoint may suspend or terminate your account immediately for material breach of these Terms (including fraud, non-payment after notice, or repeated posting of inaccurate roles). Upon termination, your access ends and your active sponsored placements are removed; free historical postings may remain visible at our discretion.
10. Disclaimers
The Service is provided "as is" and "as available". To the maximum extent permitted by law, Waypoint disclaims all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that any job posting will result in applicants, hires, or any particular click volume. Public job-board traffic depends on factors outside our control, including search-engine indexing, candidate intent, and seasonality.
11. Limitation of liability
To the maximum extent permitted by law, neither party will be liable to the other for indirect, incidental, consequential, special, or punitive damages, or for lost profits, lost data, or business interruption.
Waypoint's total cumulative liability for any claim arising out of or relating to these Terms or the Service is capped at the greater of (a) the amount you paid us in the three months immediately preceding the claim, or (b) $100. This cap is a material part of the bargain.
12. Indemnification
You agree to indemnify and hold harmless Waypoint, its officers, employees, and agents from any claim, demand, or expense (including reasonable attorneys' fees) arising out of: (a) content you post; (b) your violation of these Terms; (c) your violation of any third-party right, including employment-law, intellectual-property, or privacy rights; (d) your hiring, employment, or rejection decisions.
13. Governing law and disputes
These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles. Any dispute will be resolved exclusively in the state or federal courts located in Texas, and both parties consent to personal jurisdiction there.
Either party may seek injunctive relief in any court of competent jurisdiction to protect intellectual-property or confidentiality rights.
14. Changes to these terms
We may update these Terms from time to time. Material changes will be announced via email to the billing contact on each active account and via a notice in the dashboard at least 14 days before they take effect. Continued use of the Service after the effective date constitutes acceptance.
